Madoff victims trade on trustee's gains and losses

(Reuters) - After Bernard Madoff's fraud unravelled in late 2008, Yale Fishman was courted by Wall Street traders seeking to buy his claim to assets that could be recovered from the mess. After three years of ignoring their calls, he finally said yes.

Fishman, an estate planner in Woodmere, New York, and a former Madoff investor, cut a deal with a trading firm to sell part of his bankruptcy claim in the long-running case. He said he sold his $1.1 million (710,000 pounds) claim for $800,000, or about 73 cents on the dollar, in late December.

"I held it for a while, but they keep calling you up and soliciting you," he said. "And I figured I should sell it because I was planning for my kids," said Fishman, whose sale could not be independently verified.

As in many bankruptcies, the collapse of Madoff's financial empire spawned a mini-market of trading in the rights to any potential recoveries. Bankruptcy claims trading in the Madoff case has moved in fits and starts since Madoff was arrested, with claims currently trading in the range of 60 cents on the dollar, according to levels quoted by traders.

Recent setbacks by the court-appointed trustee trying to recoup assets on Madoff victims' behalf - combined with frustration over the trustee's legal and other fees, which to date total more than $550 million and counting - are encouraging some former Madoff customers to unload their claims. Most original Madoff claims sellers are ordinary investors, not the lenders, debt holders or vendors who are the typical sellers in other claims-trading situations.

A bankruptcy claim is essentially an IOU that gives the holder the right to a portion of any assets later recovered. The seller gets cash upfront rather than potentially waiting years for a payback, while the buyer - typically a hedge fund or bank - pays a discount to the face value of the claim in hopes of ultimately recouping more.

Claims trading has long been a Wall Street niche. Past examples of significant claims-tradings markets include those stemming from the collapse of Enron Corp. and Lehman Brothers Holdings Inc. More recently, buyers have been snatching up MF Global Holdings Ltd customer claims.

While claims trading is always a bet on the value of the bankrupt estate, trading in Madoff claims has become almost a pure bet on what the trustee, lawyer Irving Picard, can recover through his myriad court battles.

So far, Picard has won settlements of $9.1 billion through lawsuits against groups and individuals he has accused of turning a blind eye to Madoff's crimes and profiting from his scheme. Much of that money is tied up in litigation over payout calculations, however, and cannot be distributed. So far, Madoff investors have only received payments of $330 million.

Picard's office has said Madoff customers ultimately could get a full recovery of the more than $17 billion in approved claims. Picard spokeswoman Amanda Remus declined to comment on claims-trading activity or prices.

Remus said the trustee and his legal team have gotten "an extraordinary result" through their work "in reconstructing from nothing the facts and scope of the Madoff fraud and achieving record recoveries." She also said the trustee's fees are paid through funds from the Securities Investor Protection Corp., a non-profit group that charges fees to broker-dealers, not from recoveries intended for Madoff victims.

It's unclear how many Madoff investors have sold their claims, or at what prices. Because Madoff's firm, Bernard L. Madoff Investment Securities LLC, was unwound under the auspices of SIPC instead of through a Chapter 11 bankruptcy, there is no legal requirement for claims trades to be made public.

Bankruptcy claims trade in an over-the-counter market made up of small brokers who specialize in finding claims and traders from broker-dealers such as the Seaport Group, CRT Special Investments LLC and Macquarie Group. They call and send emails to potential buyers about the price and size of claims being bought and sold, meaning there are no official price quotes.

Buyers of Madoff claims have included Deutsche Bank and hedge funds Fortress Group, Monarch Capital and Silver Point Capital, according to traders involved in the transactions. Fortress did not respond for comment, while Deutsche, Monarch and Silver Point declined to comment.

PICARD'S EFFORTS

Picard's efforts to recover funds have included lawsuits against an array of banks, wealthy individuals and Madoff family members.

The defendants, who include Madoff's brother, Peter, and son Andrew, have countered that they, too, were betrayed by Madoff and that the trustee waited too long to bring some of his claims. Picard expanded his lawsuit, filed in U.S. Bankruptcy Court in Manhattan, against the family members earlier this month to $255 million, from $226 million.

In one of his earliest and biggest successes, Picard won approval in January 2011 of a $7.2 billion settlement with Madoff investor Jeffry Picower. Optimism among traders grew that the payback for claims holders would be large, and Madoff claims at that point traded above 70 cents on the dollar, according to traders who have tracked the prices.

"People thought he was going to roll through this," Joseph Sarachek, managing director at CRT, said of Picard.

Then, in September 2011, the trustee sustained some big setbacks, triggering a drop in claims prices to the mid-50-cents-on-the-dollar range, according to traders. U.S. District Court Judge Jed Rakoff in New York ruled that Picard could only reach back to the last two years of the fraud in pursuing his "clawback" lawsuits against Madoff customers who withdrew more money from their accounts than they had deposited.

The judge was considering whether Picard could seek funds from New York Mets owners Fred Wilpon and Saul Katz, who were investors with Madoff, and the ruling limited the trustee's potential recoveries. The Mets owners later settled litigation brought by the trustee.

In November, another federal judge in Manhattan threw out most of the trustee's nearly $20 billion lawsuit against JPMorgan Chase & Co and a $2 billion case against UBS AG .

Trading in Madoff claims can be thin, and prices have bounced around sharply, according to market participants. Fishman, the Madoff victim who sold a claim in December, said he executed his trade when prices climbed from earlier levels. Since then, prices have settled to around 60 cents on the dollar, said Robert Gallivan, a senior managing director at Macquarie.

But none of these price movements or legal developments matter much anymore to Madoff investors who have shed their claims. Selling the claims has given some victims, who had entrusted their life savings to the man they thought was a financial genius, a measure of closure.

"I think people understand as time goes on that this is not a fast process," said Burt Ross, a Madoff victim in Malibu, California, who said he sold his claims some time ago.

Slowly through conversations with players I'm getting a feeling for what happened in gaming around 1980 and around 1995, and how the legacies of those watersheds affect people's reactions to game innovations now.

Neither of these dates is exact, but they each represent a middle point of a process of change. There are plenty of intentional throwbacks after, some unintentional look-forwards before. But in general, games have evolved (devolved?) toward:

Low death, low frustration. Before 1980 or thereabouts frustration was an acceptable part of a game's modeling of life. This was just as true for computer games, as board games, as role-playing. OD&D's 1 hit point characters = Nethack's play-until-character-death = Dungeonquest's brutal, random death at every corner. "Stay in jail" mechanics were OK in board games back then, too (Source of the Nile, Mystic Wood...).

The AD&D Dungeon Master's Guide removed much of death's sting through a "death's door" rule covering survival from zero and negative hit points?(not at all evident in the earlier Player's Handbook). Save-or-die poison took longer to go, being finally purged for good in 3rd Edition. Computer games have shown a similar exorcism of frustration, moving from no saving of game state, to save points, to continual saving. State-of-the art design today for many casual games even gives progress for failed attempts, so that eventually the game will be defeated. Time is the commodity here, as always, but the message is "you didn't succeed" not "you failed."

Character powers for all. This broadly refers to things a character can do distinct from other characters, but more specifically combat moves that can be customized. The move toward this feature in 3rd and 4th editions usually gets blamed on computer gaming, but plenty of computer games in the 1980's and 90's used the standard D&D paradigm, where classes without spells only get to bash, shoot and hack using the standard combat procedure.

The origin of feats and the like in tabletop gaming can probably be traced to the prevalence of special character moves in fighting console games, and to increasing modularity and customization in the gaming world under the influence of collectible card games.

On to the present day.

D&D Next, as much as it draws from the old school, also has strong representation from these two concerns in the system. It's obvious that hit points are numerous, the margin of safety for low-level characters is great, and healing remains as available as in 4th edition. It's also obvious that classes, races, and "paths" each come with an addition to a suite of powers that can leave a 3rd level character looking at 3-5 different combat traits and moves.

And now my confession: My campaign players expect these features to some extent, steeped as they are in MMOs. And so on both counts I have gone about half the way that D&D Next appears to have done. I used a "death & dismemberment" system at 0 hit points or below that is scary, but in practice merciful. Save or die poison is a bridge we haven't had to cross, but I'm inclined to offer multiple saves on poison (one to be seriously incapacitated and one to die.) Meanwhile, class powers and fighting feats in my game are running about half the count of D&D Next, but still give enough of a sense of things to do.

To put it shortly: In order to compete with my homebrew, D&D 5th Edition is going to have to give me the option to cut down on the bones it throws to millennium-era gaming, and let me run a game at my desired level of "old world charm and new world convenience."

SAN ISIDRO, Colombia (AP) ? A French journalist freed by leftist rebels Wednesday said he had no complaints about his captivity other than its 33-day duration and lamenting that it is only the poor who die in Colombia's "invisible conflict"

Romeo Langlois said he was not embittered, but he criticized the rebels for using his capture for propaganda purposes. They freed him on their movement's 48th anniversary on a specially built stage in this remote southern hamlet, hanging banners expressing a desire for peace and drawing a crowd with a barbecue.

But the rebels and the townspeople they convened in this longtime guerrilla stronghold for the handover to a humanitarian commission applauded vigorously when Langlois said he appreciated how the guerrillas "live in the mud and risk their lives."

"They never tied me up," Langlois, 35, said of the Revolutionary Armed Forces of Colombia. "Rather, they always treated me as a guest. They gave me good food ... They were always respectful."

Langlos looked relaxed and smiled, appearing unbothered by the wound to his left arm suffered during an April 28 attack by rebels on the soldiers he was accompanying on a mission to destroy cocaine laboratories.

He was asked after rebels delivered him in a green Toyota Land Cruiser what he took from his captivity, which occurred just a few miles away.

"I didn't need this experience to know the Colombian conflict or to know the rebels. I've been in this a long time," said Langlois, who has been reporting on it for more than a decade for France24 television and the newspaper Le Figaro.

"What I take from it is the conviction that one must continue covering this conflict," Langlois added.

It was not immediately known if Langlois, a bachelor, would fly to France to be reunited with his parents.

He made no apologies for accompanying the military. The FARC, as the rebels are known by their Spanish initials, had criticized him in an early May communique as lending himself to government propaganda by doing so.

"I hope the army doesn't stop taking people to conflict zones, and let's hope the rebels also take journalists with them to show the daily life of their combatants because this conflict isn't being covered," Langlois said.

Three soldiers and a police officer were killed in the morning-long firefight that saw Langlois captured. A guerrilla commander told independent journalist Karl Penhaul last week that Langlois was lucky, saying an AK-47 bullet entered his left arm above the elbow and exited the forearm without damaging bone or cartilage.

Langlois said he watched a sergeant die, just a meter away, during the battle.

Before fleeing toward the rebels, the journalist shed his helmet and body armor that the military had provided. The insurgents later said they took him prisoner because he was wearing military garb and they couldn't tell he was a civilian.

The delegation that received Langlois included French diplomat Jean-Baptiste Chauvin, former Colombian Sen. Piedad Cordoba and the Red Cross country chief, Jordi Raich. It arrived on rutted dirt roads from the state capital of Florencia in two Red Cross vehicles and lunched with the rebels and Langlois on chicken and rice after the handover ceremony.

Residents of San Isidro, which lacks running water and electricity and lives off cattle and coca, slaughtered six calves for the occasion, and rebel commanders gave brief speeches, expressing their desire for peace.

Langlois, who recorded the events with a small video camera, said in a brief speech from the stage that he lamented that "we are at a point at which this conflict has become invisible."

It is a war in which there are "neither good nor bad," and in which "the poor are killing the poor," he said.

Before the handover, a public address system played FARC revolutionary songs as hundreds of farmers converged on the hamlet. Theirs is a region of deep jungles, fast-moving rivers and villages that appear on no maps. Communal leaders complained of the state's absence: the lack of health care and poor roads that prevent them from getting their crops to market.

Langlois won applause when he expressed his understanding for why people "cultivate their little bit of coca so they can buy bread and notebooks for their children."

Political analyst Alejandro Vargas called Wednesday's event remarkable because Colombians see the FARC so rarely these days, the U.S.-backed military having increasingly driven the rebels into the country's backwaters and across the border into Venezuela and Ecuador.

"I would think that for the average citizen it doesn't have much relevance," he said. "In an armed conflict both parties take whatever opportunity they can to make propaganda and demean the other."

The government of President Juan Manuel Santos, who had from the start demanded Langlois' release, did not immediately comment.

But Santos' predecessor, Alvaro Uribe, was among Colombians expressing displeasure with the rebel spectacle.

"Langlois, what were you doing in Colombia," he said via Twitter. "What relation to you have with the FARC? Some of us know that you know how to deceive."

During Langlois' captivity, Uribe had called him "rude" and complained about his aggressive questioning.

Colombia's government suspended military operations in the handover zone for a 48-hour period that ends at 6 p.m. Thursday.

San Isidro's village council leader, German Pena, told The Associated Press before the ceremony that "war is something we experience almost every day."

"There have been innumerable battles in this area," he said. "They think we're part of the guerrilla forces just because we live in this region and for that reason they target us sometimes."

The government says the FARC funds itself largely through the cocaine trade. It has an estimated 9,000 fighters, and recently stepped up hit-and-run attacks on soldiers and police after suffering years of setbacks.

Langlois' capture followed the rebels' February announcement that they were ending ransom kidnapping as a good-faith gesture in hopes of launching peace talks.

Last month, they released what they called their last "political prisoners," 10 soldiers and police officers held for as long as 14 years.

There goes another one ? RIM announced today that Chief Legal Officer Karima Bawa will soon be leaving the company. This is RIM?s second major departure in as many weeks, with RIM sales head Patrick Spence leaving the ailing smartphone maker last Wednesday.

At the time, sources pointed to audio electronics company Sonos as his likely landing spot, though neither Spence nor Sonos have officially commented on the situation.

Unlike Spence, who reportedly jumped ship after being passed over for the company?s vacant COO spot (Sony Mobile EVP Kristian Tear eventually got the job), Bawa?s situation seems much less contentious. After spending nearly twelve years with the company (two of which were in her current spot), she?s finally looking to retire.

According to Reuters, Bawa?s departure was no surprise ? she apparently revealed her desire to leave months in advance, and will be sticking around long enough to get her successor up to speed.

Still, a loss is a loss, and if recent reports are to be believed there are plenty more to come. Rumblings of a new round of layoffs have making the rounds lately, with the Financial Post reporting yesterday that nearly 6,000 employees are said to be on the proverbial chopping block.

RIM laid off 2,000 employees as part of a drastic cost cutting measure in July 2011 which acccounted for 11% of the company?s total workforce at the time. If these latest layoffs indeed come to pass, RIM will (for better or worse) be smaller than it has been in years. The Waterloo-based company needs to put as much of their effort as possible into crafting their forthcoming BlackBerry 10, and it remains to be seen whether or not this new, lean RIM is up to the task. Their early focus on luring developers to the platform with developer-friendly hardware and tools was a smart one, but market share shrinking and a launch window that could put it up against stiff competition, RIM can?t really afford for it to be anything other than a homerun.

UC Davis mathematicians have helped biologists figure out why platelets, the cells that form blood clots, are the size and shape that they are. Because platelets are important both for healing wounds and in strokes and other conditions, a better understanding of how they form and behave could have wide implications.

"Platelet size has to be very specific for blood clotting," said Alex Mogilner, professor of mathematics, and neurobiology, physiology and behavior at UC Davis and a co-author of the paper, published this week in the journal Nature Communications. "It's a longstanding puzzle in platelet formation, and this is the first quantitative solution."

Mogilner and UC Davis postdoctoral scholars Jie Zhu and Kun-Chun Lee developed a mathematical model of the forces inside the cells that turn into platelets, accurately predicting their final size and shape.

They were collaborating with a team led by Joseph Italiano and Jonathon Thon at Harvard Medical School and Brigham and Women's Hospital, Boston.

Platelets are made by bone marrow cells called megakaryocytes. They bud off first as large, circular pre-platelets, form into a dumbbell-shaped pro-platelet, then finally divide into a standard-sized, disc-shaped platelet. A typical person has about a trillion platelets in circulation at a time, and makes about 100 billion new platelets a day, each living for 8 to 10 days.

Inside the pre- and pro-platelets is a ring of protein microtubules, which exerts pressure to straighten and broaden the nascent cells. But overlying the ring is a rigid cortex of proteins that prevents the platelets from expanding.

By tweaking the number of microtubules in the bundles, Mogilner, Zhu and Lee found that they could correctly predict how pro-platelets would flip into a dumbbell shape, as well as the size and shape of mature platelets.

(AP) ? The federal judge in the perjury trial against former major league pitcher Roger Clemens has excused a third juror, leaving just one alternate as the trial enters its seventh week.

U.S. District Judge Reggie Walton told lawyers Tuesday that the juror won't be able to return following the death of her mother last week. The juror works in law enforcement with the local public transportation authority in Washington, D.C.

Two jurors previously were dismissed for sleeping.

Clemens, a seven-time Cy Young Award winner, is accused of lying to Congress in 2008 when he denied using steroids or human growth hormone.

Clemens' lawyers say they will need seven or eight court days to put on their defense, which is expected to start Tuesday.

Super-sensitive tests could detect diseases earlier

ScienceDaily (May 27, 2012) ? Scientists have developed an ultra-sensitive test that should enable them to detect signs of a disease in its earliest stages, in research published May 27in the journal Nature Materials.

The scientists, from Imperial College London and the University of Vigo, have created a test to detect particular molecules that indicate the presence of disease, even when these are in very low concentrations. There are already tests available for some diseases that look for such biomarkers using biological sensors or 'biosensors'. However, existing biosensors become less sensitive and predictable at detecting biomarkers when they are in very low concentrations, as occurs when a disease is in its early stages.

In the new study, the researchers demonstrated that the new biosensor test can find a biomarker associated with prostate cancer, called Prostate Specific Antigen (PSA). However, the team say that the biosensor can be easily reconfigured to test for other diseases or viruses where the related biomarker is known.

Professor Molly Stevens, senior author of the study from the Departments of Materials and Bioengineering at Imperial College London, said: "It is vital to detect diseases at an early stage if we want people to have the best possible outcomes -- diseases are usually easier to treat at this stage, and early diagnosis can give us the chance to halt a disease before symptoms worsen. However, for many diseases, using current technology to look for early signs of disease can be like finding the proverbial needle in a haystack. Our new test can actually find that needle. We only looked at the biomarker for one disease in this study, but we're confident that the test can be adapted to identify many other diseases at an early stage."

The team demonstrated the effectiveness of their biosensor by testing PSA biomarker samples in solutions containing a complex mixture of blood derived serum proteins. Monitoring the levels of PSA at ultralow concentrations can be crucial in the early diagnosis of the reoccurrence of prostate cancer, but classic detection approaches are not sensitive enough to carry out this analysis with a high degree of accuracy. The new test could enable more reliable diagnosis, but more research will need to be done to further explore its potential.

In their study, the team detected PSA at 0.000000000000000001 grams per millilitre, which is at the limits of current biosensor performance. By comparison, an existing test called an Enzyme-Linked Immunosorbent Assay (ELISA) test can detect PSA at 0.000000001 grams per millilitre, which is nine orders of magnitude more concentrated.

The biosensors used in the new study consist of nanoscopic-sized gold stars floating in a solution containing other blood derived proteins. Attached to the surface of these gold stars are antibodies, which latch onto PSA when they detect it in a sample. A secondary antibody, which has an enzyme called glucose oxidase attached to it, recognises the PSA and creates a distinctive silver crystal coating on the gold stars, which is more apparent when the PSA biomarkers are in low concentrations. This silver coating acts like a signal that PSA is present, and it can be easily detected by scientists using optical microscopes.

The next stage of the research will see the team carrying out further clinical testing to assess the efficacy of the biosensor in detecting a range of different biomarkers associated with conditions such as HIV and other infections. They will also explore ways of commercialising their product.

(AP) ? President Barack Obama is paying tribute to veterans during Memorial Day weekend, honoring those willing to sacrifice their lives for their country.

Obama says in his weekly radio and Internet address he will mark Monday's holiday with veterans and their families at Arlington National Cemetery and the Vietnam Veterans Memorial.

The president says the nation needs to honor veterans, including those who served in Iraq and Afghanistan, by ensuring they have access to health care, higher education and jobs.

In the Republican address, Rep. Lynn Jenkins of Kansas says higher prices from gasoline to groceries have placed a strain on families. She is calling for building the controversial Canada-to-Texas Keystone XL oil pipeline.

Savannah was diagnosed with brain cancer on August 14, 2006, but that is not where her story begins. In March 2005 she was diagnosed with Diabetes Insipidus (DI); a disorder caused by the brain not sending signals to the pituitary gland for a hormone to be released to absorb excess water from the kidneys. One of the causes of DI is a brain tumor, so Savannah had a MRI in March 2005. No tumor was detected. She began taking the needed hormone by mouth twice a day and saw an endocrinologist regularly.

Toward the end of 2nd grade Savannah started complaining of headaches. In June 2006 she had her 8-year-old checkup and she failed the eye exam; we thought that explained the headaches. We made an appointment with an eye doctor for the end of July and went on about our summer. When Savannah?s eyes were examined on July 31, 2006 no problems were detected. Savannah was not acting like herself; she was sleeping a lot and moody. I called her pediatrician and we discussed doing another MRI. From that MRI her tumor was found. We were sent to Atlanta on August 4, 2006, but once we got there found out our insurance was not accepted. An appointment was made to go to Shands in Gainesville, FL, but the pediatric neurosurgeon was on vacation until August 14 ? so we waited. We thought her tumor was benign at this point, due to the location and how it ?looked? on the MRI. Toward the end of the week of waiting Savannah started to deteriorate; she was vomiting, sleeping much of the time and losing her eyesight.

We got to Shands on August 13, 2006 and went to the ER. They did blood work and another MRI on August 14. The blood work showed Savannah had cancer. She had a mixed germ cell brain tumor near her pituitary. She received six rounds of chemo and then had brain surgery to try to remove what was left of the tumor. Unfortunately, the 1cm tumor that remained was not able to be removed, but the surgeon is fairly certain it is basically scar tissue. After Savannah healed from brain surgery she had six weeks of cranio-spinal proton radiation in Jacksonville, FL. Savannah was declared ?cancer free? when her treatment ended on March 13, 2007!

Although treatment for the cancer is over, childhood cancer survivors are far from ?out of the woods?. Childhood cancer survivors battle the rest of their lives. Chemo and radiation have long term effect ? a few are: cognitive loss, fertility issues and personality changes. These special survivors are at an increased risk for developing other cancers due to their treatments. Due to the location of Savannah?s tumor she has no pituitary function and must replace all hormones, including growth hormone shots she endures every night.

Savannah is now a bright, beautiful, fun-loving 13-year-old. She has yearly MRI?s and checkups with her oncologist and sees her endocrinologist every four months. Savannah is aware of how fortunate she is to be a survivor; she is our miracle!

Pool access for the disabled sparks controversy

(AP) ? The Obama administration is sidestepping an election-year confrontation with the hotel industry and other pool owners to give them more time to comply with access rules for the disabled.

The rules have been in the works since the early 1990s, but the Justice Department created an uproar among hotels, waterparks, health clubs and the like earlier this year when it said it will require many such facilities to install fixed lifts to comply with the Americans With Disabilities Act.

After initially setting a March 15 deadline ? and telling the industry it wouldn't budge ? the department has granted two extensions. After first saying it might grant a reprieve until September, Justice announced last week that pool owners won't have to comply with the new requirements until early next year, a move that gets the controversy safely past the election.

At issue is whether hotels and other facilities will have to install fixed lifts to assist disabled people getting in and out of their pools, a move that can require hiring a contractor and tearing up the pool deck at a cost of as much as $6,000. Many pool owners were hoping to comply with the rules by purchasing less costly portable lifts that could be wheeled out to poolside as needed. Hotel owners who already have lifts say few of their customers ever ask for them.

Advocates for the disabled are frustrated by the delay, saying it means another summer swim season without lifts at most pools. They accused the hotel industry of creating an 11th hour tempest to undo rules that have been in the making since the Clinton administration.

"It's a little disingenuous to say that came out of nowhere," said Heather Ansley, a lawyer with United Spinal Association.

But they're pleased that Justice isn't caving to demands that everybody be allowed to get by with portable lifts.

"They've been trying to duck it for 10 years, and the agency keeps putting it off, putting it off," said Rep. Jerold Nadler, D-N.Y. "Enough already."

Disabled people complain that in cities where lifts are already required, portable lifts are often stowed away and that not all employees know how to operate them. And they say that the hotel and motel industry has a long record of trying to evade access rules for the disabled, sometimes waiting to be sued before complying.

The issue gets even trickier. There's a longstanding exemption in the law that says existing facilities can avoid an ADA requirement if they determine compliance is not "readily achievable." That's pretty ambiguous, but as defined in the law it basically means you're eligible for the exemption if you determine that it's too difficult or expensive. Figuring out whether one qualifies for the exemption can be difficult.

The rules always had been going to require that newly constructed pools be required to have built-in lifts. But in January, Justice issued technical guidance that for the first time required fixed pool lifts at existing pools, said Minh Vu, a Washington lawyer representing the hotel industry. That took many pool owners by surprise, upending their plans.

The guidance created a new set of potential problems and concerns. Among them was that children might climb on the lifts ? which would be built at the shallow end of the pool ? and potentially hurt themselves by falling or diving off.

The January directive put hotel owners in a real bind. Over the horizon they saw themselves being hit with government penalties and private lawsuits for failing to comply with the rules. Some hotels announced they would have to close their pools. Community and municipal pools risked being out of compliance as well.

The uproar quickly made its way to Capitol Hill. Several members of Congress prepared legislation to roll back the fixed lift requirement. At the same time, hotels flooded the Justice Department with complaints about being unable to meet the deadline.

A week ago, Justice announced that pool owners now have until Jan. 31, 2013, to comply with the rules.

"We got such an overwhelming response indicating the widespread misunderstanding of the law and indicating that the pool lift manufacturers are having trouble meeting the demand, so we wanted to make sure people had enough time," Eve Hill, a senior attorney in the Justice Department's civil rights division, said.

On Thursday, Justice said pool owners who bought a portable lift before the original March 15 deadline two months ago would be considered in compliance as long as the lift is in place whenever the pool is open. And it made clear that portable lifts can be used if they're attached to the pool deck.

The department also hopes to clear up confusion among hotel operators about whether their circumstances qualify them to get by with a somewhat less expensive portable lift or win exemption from the requirement altogether.

Hotel industry lobbyists, meanwhile, succeeded in getting the House to block the Justice Department from implementing the new regulation requiring permanent pool lifts as part of a spending bill for next year. The idea could get a Senate vote next month.
