3 Steps to a Remarkable New Year: Review, Reflect, Resolve | The ...

As the year comes to a close, amidst the hectic holiday and business year end ?to-dos,? I urge you to find some quiet time just for yourself. Sit or walk, be still or move ? whatever helps you have an open and clear mind. Bring along a pad of paper or your favorite electronic device and give yourself the precious gift of reflective, uninterrupted time to set your intention for a remarkable new year.

Review

1. First, spend some time reviewing the year you have had both personally and professionally. Don?t be too easy or too hard on yourself. Don?t beat yourself up for what you didn?t accomplish or for mistakes and failures. Rather, just summarize and describe the year you?ve had in a few words or in a sentence or two.?At the end of this review, if you are so inclined, write a headline to a story about the prior year.

Reflect

2. Once you?ve managed to succinctly describe your year, spend some time considering how you feel about the statements you came up with. Are you proud? Are you sad? Are you inspired? Are you encouraged or discouraged? What have you learned about yourself and your work this past year? What can you build on? What should you discard or abandon to create more space so you can better achieve what you set out to accomplish.

Resolve

3. Think ahead to next year. See if you can tap into your true sense of purpose, that which ignites your true spirit. How do you want to describe your year at the end of 2013? How do you want to feel? What would be and feel so right for you? For now, don?t set goals, timelines or actions. Instead, set an overall intention for your year. Consider, above all what you intend to create for yourself, your business and your career.

Ruminate on your intention for awhile. Sit with it, embrace it, play it out over and over in your mind. If its helpful to you, share it with a trusted friend, mentor or sponsor.?Ask yourself, if you can truly own it. Are you fully committed to manifest this intention?

Tentative "fiscal cliff" deal emerges in Senate

WASHINGTON (Reuters) - U.S. Senate leaders were hammering out a last-minute deal to avoid the "fiscal cliff" on Monday, but it was still unclear if rank-and-file lawmakers would back the agreement, particularly those in the Republican-led House of Representatives.

A deal to avert the fiscal crisis was said to be in the works in the Senate that would raise tax rates on household income above $450,000, said a source familiar with the talks. The agreement would permanently extend the lower tax rates for those below the $450,000 cut off. These lower tax rates have been in place for all taxpayers since the Bush administration.

U.S. stocks rose modestly on the news, with the benchmark Dow Jones industrial average up less than one percent at 13,011.

With only hours to go before the midnight deadline, the source said, the Senate deal would permanently fix the alternative minimum tax and postpone for an undetermined period the automatic, across-the-board federal spending cuts in defense and domestic programs.

The estate tax on inherited assets would increase under the Senate proposal. Corporate tax benefits would be extended, including the research and development tax credit, and unemployment insurance benefits for the long-term jobless would be extended for a year, the source said.

Dividends and capital gains would be taxed at 23.8 percent for high-income households under the Senate package. That would be an increase from the existing rate of 15 percent.

A Democratic aide cautioned that no deal was complete until all the elements were addressed and said it was unsure whether the package being negotiated could pass the Senate.

Republican Leader Mitch McConnell, walking into the Capitol after working late into the night on Sunday, told reporters he had been speaking with Democratic Vice President Joe Biden.

Senate leaders and Biden have been working to forge a pact that would have a chance of passage in both chambers.

HIGHER TAXES AHEAD

From wage-earners to investors, Americans were all but certain to face higher payroll taxes and investment income taxes even if Congress can pull off a deal to avoid the fiscal cliff.

The source made no mention of a tentative Senate compromise to extend President Barack Obama's payroll tax holiday that Americans have enjoyed for two years. Support for such an extension seems to have faded away, in part because the payroll tax funds Social Security. If it ends, the current 4.2 percent payroll tax rate paid by about 160 million workers will rise to the previous 6.2 percent rate after December 31.

That will be the most immediate hit to consumers, who will feel a squeeze on their wallets. Economists have warned that a recession could result if the full sweep of the fiscal cliff is allowed to take hold in January.

At midnight, low tax rates enacted under former President George W. Bush in 2001 and 2003 are set to expire. This remains the most contentious part of the ongoing negotiations, which has many other facets, including investment income tax increases.

A main sticking point has been whether to raise taxes on the wealthy. Republicans had opposed any tax rate hike, while Democrats for most of this year argued that household incomes above $250,000 should see higher tax rates.

If no deal is reached, the tax increases that will result from plunging off the fiscal cliff could be curbed later with retroactive legislation, but some economic damage seemed likely, dependent in part on the reaction of financial markets.

Kanex mySpot


The Kanex mySpot ($59.99 MSRP) is a tiny access point (AP) used to create a wireless network when you only have one wired Internet connection. MySpot is handy if, for example, you are in a hotel room or convention hall and only have access to one live Ethernet cable. Kanex specializes in devices for Apple, and keeping in line with the wants of many Apple fans, the company makes mySpot very easy to set up. In fact setup is much simpler than most other travel routers and access points?it's practically plug-and-play. But this device serves only as a wireless AP: It doesn't offer any router functionality.

This means you don't get DHCP capabilities or the ability to create a robust network in which clients can share data. The Kanex mySpot can only deliver Internet access to wireless clients in the situation where you only have one wired connection via an Ethernet cableMySpot also is limited in that it only supports WEP and 802.11 b/g. While it works as advertised, there are other travel routers on the market that deliver more functionality.

Specs
The pocket-sized mySpot looks like a chunky Pez candy dispenser. Its dimensions are 2.27 "x 1.0" x 0.75" (HDW). The device connects to a USB 2.0 or 3.0 port on a laptop or some other client. The USB plug tucks into a groove on the mySpot and is removed from that groove when plugging into a laptop, for instance. The other end of mySpot has a soft, removable cap which exposes an Ethernet port.

MySpot can only create a 2.4GHz WLAN that supports 802.11b/g. It also supports only WEP security, lacking the more secure WPA and WPA2. You can password-protect the WLAN you create with a 5 or 13 character ASCII password. Still, I would be hesitant to conduct any sensitive Internet business with this setup, such as online banking or shopping with credit cards.?

Because mySpot is an AP and has no routing functionality, it picks up the settings of the network of the wired Ethernet connection. So whatever IP addressing information that Ethernet cable's network has, will be passed onto any clients connected to the mySpot wirelessly. You have no control over IP addresses with the Kanex device.? Again, since the purpose is not to create a full-featured wireless LAN, that's suitable for those only looking to get their tablet and smart phone connected to the single Internet connection available in a hotel room.

Setup
To set up mySpot, I plugged the USB connector into a USB 2.0 port of a Dell laptop. I then plugged an Ethernet cable attached to DSL broadband into the MySpot's Ethernet port.

MySpot has two LEDs?one lights blue up when it detects a live Internet connection, and the other lights up red when it's connected to USB (I find it absolutely annoying when vendors use a red LED for a problem-free connection on networking products. Most network administrators are only used to seeing reds and oranges when there are connection issues!)

After I connected the mySpot, I had an unsecured SSID named Kanex MySpot-A5F. I connected to this network and was able to get into the mySpot's web-based interface. There isn't a lot to configure with this simple device. You can change the SSID from the default as well as create a password, or change the wireless channel. This is the extent of the settings. You can't even hide the SSID for extra protection against prying eyes. That's all there really is to setup.

I was easily able to connect two laptops to the mySpot WLAN using either a 5 character or 13 character password. I was able to connect an Android phone with no security, but once I set up either a 5 or 13 character password enabling WEP, I could not connect my phone. This is a potentially major problem with the mySpot. Not all devices can connect with WEP encryption. Once I removed the password (removing the WEP encryption) I was able to connect my Android phone without issue. For Kanex to be of more value, it would need to have WPA2 encryption, which is supported by most popular wireless devices and gadgets.

Easy Setup is Best Feature
I really like how easy mySpot is to set up. Travel routers and APs can often be confusing to configure for the average user on the go. Unfortunately, a lack of modern-level wireless encryption and no support for 802.11N are major oversights with this device. Since it works as advertised, it gets 2.5 out of 5 stars. Cowboys Stadium To Host Four Simultaneous NCAA Games

While the details have yet to be finalized, there will be four simultaneous games played at Cowboys Stadium on Veterans Day in 2013.

The games will begin 15 minutes apart and be held side by side under the roof of Cowboys Stadium.

"We're going to squeeze everything into a three-hour time period," Michigan State athletic director Mark Hollis said. "We're talking with eight institutions right now that have a very high interest and have that weekend open, and we're going to partner with the 12 [military] bases that are around Dallas, so we can make it a celebration for the guys at Fort Hood and others."

Michigan State will be one of the eight teams to participate.

On Italian bonds: Why positions on Rome weren't built (or lost) in a day

What?s the definition of not caring? The simple fact is that the growth potential simply isn?t there.?After the seven fat years should come the seven lean years but as European governments failed to follow Joseph?s biblical advice to the Pharaoh and make provisions during the good times, the tough times which followed have been converted into a full blown famine.

In the fullness of time, it will be the right trade but how to overcome the mark to market risk while getting there is one of the key conundrums of modern investing.

Italy has a long history of short lived governments which must, at some point, beg the question as to whether the country?s economic success ? and the huge leap forwards in the past fifty years should not be underestimated ? is because of despite the shenanigans of Rome politicians?

Orson Welles gave Harry Lime in ?The Third Man? the immortal words that: ?In Italy for 30 years under the Borgias they had warfare, terror, murder and bloodshed, but they produced Michelangelo, Leonardo da Vinci and the Renaissance. In Switzerland they had brotherly love ? they had 500 years of democracy and peace, and what did that produce? The cuckoo clock.? (I?m sure I don?t have to add that the cuckoo clock is in fact German, but I don?t think that such a detail blunts the point).

Italy v Spain

Joking aside, the Italy/Spain 10yr yield spread has contracted back into the 90bp area as investors continue to toss the two masters of the garlic belt into the same pot. More wrong they could not be. In November last year Italy in fact traded north of Spain. Then too I warned of misunderstanding the core difference between the two. Spain has a responsible government fighting to manage a country with no meaningful industrial economy. Italy has irresponsible government ably succeeding in mismanaging a more than just reasonably competent industrial economy. If I was in the business of trading Italy against Spain, I?d be long the former all day long and yet I?d have had my glutes handed to me on a plate several times in that past year or so. In the fullness of time, it will be the right trade but how to overcome the mark to market risk while getting there is one of the key conundrums of modern investing.

I had to laugh this morning at the headline ?JPMorgan Investment Bank Bonus Pool Said to Fall as Much as 2%.? As ?much? as 2% ? they?re having a laugh! The CIO Office CDS losses were supposed to amount to over US$6bn when the bank?s net for the year will hit something in the area of US$20bn ? after the write down ? and the bonus pool is only down by 2%?

The argument is supposed to be that the losses were not taken in CIB but in the CIO in London and that therefore the performance related pool is protected. You might get it and I might get it but whether lawmakers and shareholders get it (other than right between the eyes) is another matter entirely.??

Weymouth church?s Little Christmas celebration to benefit food pantry

A brass ensemble from America?s oldest community orchestra will be among the featured performers at the 14th annual A Little Christmas in Jackson Square on Sunday, Jan. 6.

Players from the Southeastern Philharmonic Orchestra will join the choirs of East Weymouth Congregational Church and Immaculate Conception Parish in the ecumenical musical celebration of Epiphany. Also known as Little Christmas or Three Kings? Day, the Epiphany in Christian tradition commemorates the visit of the magi bearing gifts for the baby Jesus and the revelation of the child to the non-Jewish world.

It will be held at 3 p.m. in the sanctuary of the church, 1320 Commercial St. at Jackson Square. Admission is free, but a voluntary donation is collected to benefit the Weymouth Food Pantry. The concert as raised more than $10,000 for the pantry since 2003.

?A Little Christmas in Jackson Square is a gift from the musicians to one another and to the community. Many people have told us over the years that this is a great way to end the Christmas season and to start the new year,? said Victor DeRubeis, director of music at the church, who founded the concerts in 1999.

?We?re happy to collaborate with the SPO players, since the orchestra has made the church its rehearsal and performance home for years.?

Other groups to be featured will include the First Church Chime Group plus other instrumentalists and vocalists. The concert also includes a sing-along and concludes with the ?Hallelujah Chorus? from Handel?s ?Messiah? featuring the 50-voice Little Christmas in Jackson Square Great Choir accompanied by the church?s historic Hutchings-Votey pipe organ.

'Bigfoot' is part human, claims study based on purported Sasquatch DNA

Genetic testing confirms the legendary Bigfoot is a human relative that arose some 15,000 years ago ? at least according to a press release issued by a company called DNA Diagnostics detailing supposed work by a Texas veterinarian.

The release and alleged study by Melba S. Ketchum also suggests such cryptids had sex with modern human females that resulted in hairy hominin hybrids, but the scientific community is dubious about her claim.

"A team of scientists can verify that their five-year long DNA study, currently under peer-review, confirms the existence of a novel hominin hybrid species, commonly called 'Bigfoot' or 'Sasquatch,' living in North America," the release reads. "Researchers' extensive DNA sequencing suggests that the legendary Sasquatch is a human relative that arose approximately 15,000 years ago."

For her study, Ketchum obtained three "whole nuclear genomes from purported?Sasquatch?samples. The genome sequencing shows that Sasquatch mtDNA is identical to modern?Homo sapiens, but Sasquatch nuDNA is a novel, unknown hominin related to?Homo sapiens?and other primate species." (Mitochondrial DNA, or mtDNA, is the DNA that resides in the cell's energy-producing structures, and is typically passed down from mothers, while nuclear DNA, nuDNA, resides in the cells' nuclei and is passed down from both parents to offspring.)

"Our data indicate that the North American Sasquatch is a hybrid species, the result of males of an unknown hominin species crossing with female Homo sapiens," the statement reads. [Infographic: Tracking Belief in Bigfoot]

Any proof?

It's a fascinating theory.

So where's the evidence? Well, there is none. Not yet, anyway: Ketchum's research has not appeared in any peer-reviewed scientific journal, and there's no indication when that might happen. If the data are good and the science is sound, any reputable science journal would jump at the chance to be the first to publish this groundbreaking information. Until then, Ketchum has refused to let anyone else see her evidence.

Of course the?history of Bigfoot?is rife with exaggerated and premature claims about?proof of the creature's existence. For decades, various types of evidence have been offered as final, definitive proof, ranging from Bigfoot hair to blood to dead bodies. Without exception, the evidence has always been hoaxed, misidentification or inconclusive.

Because Ketchum has released no information at all about her findings (nor have they been examined by outside experts), it's impossible to evaluate the validity of her conclusions. But an important clue can be found in her statement that "Sasquatch mtDNA is identical to modern?Homo sapiens."

If the mitochontrial DNA is identical to?Homo sapiens?(i.e., modern humans), then this suggests one of two options. The first, endorsed by Ketchum, is that Bigfoot ancestors had sex with women about 15,000 years ago and created a half-human hybrid species currently hiding across North America. There is, however, another, simpler interpretation of such results: The samples were contaminated. Whatever the sample originally was ? Bigfoot, bear, human or something else ? it's possible that the people who collected and handled the specimens accidentally introduced their DNA into the sample, which can easily occur with something as innocent as a spit, sneeze or cough. No one outside of Ketchum's team knows how this alleged Bigfoot DNA was collected, from where or by whom. It could have been collected by the world's top forensics experts, or by a pair of amateur Bigfoot buffs with no evidence-gathering training.

Confirming it's Bigfoot

How did the team definitively determine that the samples were from a Bigfoot? Did they take a blood or saliva sample from?a living Bigfoot? If so, how did they get that close, and why didn't they simply capture it or photograph it? If the samples were found in the wild, how do they know it wasn't left by another animal ? or possibly even a hunter, hiker or camper who left human genetic material?

Previous alleged Bigfoot samples subjected to DNA analysis have been deemed "unknown" or "unidentified." However, "unknown" or "unidentified" results do not mean "Bigfoot." There are many reasons why a DNA sample might come back unknown, including that it was contaminated or too degraded by environmental conditions. Or it could simply mean that the animal it came from was not among the reference samples that the laboratory used for comparison. There is no reference sample of?Bigfoot DNA?to compare it with, so by definition, there cannot be a conclusive match.

Ketchum also issued a statementrequesting that the U.S. government immediately recognize Bigfoot as "an indigenous people and immediately protect their human and Constitutional rights against those who would see in their physical and cultural differences a 'license' to hunt, trap, or?kill them." Since no Bigfoot has ever been hunted, trapped or killed, it's not clear that the creatures ? if they exist ? require any special federal protection.

Ketchum's is not the only genetics-based project intended to find Bigfoot. Earlier this year, researchers from Oxford University and the Lausanne Museum of Zoology announced they were collecting samples of?alleged Bigfoot and Yeti hair?for genetic identification. Oxford geneticist Bryan Sykes collected materials from the public from May through September, and is currently conducting DNA analysis. Once the results are in, he plans to submit his results to a peer-reviewed scientific journal.

If Ketchum has the definitive proof she claims, the world will soon know about it, and Bigfoot will be proven once and for all. On the other hand, if the evidence never appears, or is inconclusive and flawed, the search will continue.

Former President George W. Bush made a rare foray into public policy on Tuesday when he urged the nation's leaders to take a "benevolent" approach to reforming the nation's immigration system.

Bush, who has maintained a low political profile since departing office four years ago, spoke briefly about immigration at the Federal Reserve Bank of Dallas, a talk that was part of a daylong conference on immigration and the economy.

"America can become a lawful society and a welcoming society at the same time," Bush said, according to the Texas Tribune. "As our nation debates the proper course of action on immigration reform, I hope we do so with a benevolent spirit and keep in mind the contributions of immigrants.

"Not only do immigrants help build the economy, they invigorate our soul," Bush added.

Bush has said one of his major regrets about his presidency is that he did not manage to pass immigration reform. In 2007, he hammered out a deal that would have put millions of illegal immigrants in the country on a lengthy path to citizenship. The measure died in the Senate when Bush couldn't persuade enough members of his own party to vote to consider it.

Immigration reform is again a hot topic in Congress after President Barack Obama won more than 70 percent of the Hispanic vote in November. Some leading Republicans have said the party must address reform in order to stay competitive with the growing demographic. Last week, Sen. Kay Bailey Hutchison, R-Texas, introduced a bill that would give young illegal immigrants visas if they join the military. So far, it's faced criticism from immigrant groups, who say they won't accept reform bills that don't provide full citizenship.

Mars Rover Discovery Hype a Big Misunderstanding

SAN FRANCISCO ? The chief scientist for NASA's Mars rover Curiosity was just excited about the mission, and thrilled that one of the six-wheeled robot's key instruments was acing its first Red Planet tests. That's all he meant to convey.

But when an NPR story last month quoted John Grotzinger as saying that data recently gathered by Curiosity's Sample Analysis at Mars instrument, or SAM, were destined "for the history books," the world imposed its own interpretation.

Rumors begin flying around the Internet that SAM had perhaps detected complex organic compounds ? the carbon-containing building blocks of life as we know it ? on the Red Planet.

What Curiosity found

SAM's actual findings, which were revealed Monday (Dec. 3) in a press conference here at the annual fall meeting of the American Geophysical Union, are intriguing but fall a bit short of the fevered speculation. SAM has detected simple, chlorinated organics ? chemicals containing carbon and at least one chlorine atom ? but it's unclear if the carbon within them is native to Mars or whether it hitched a ride from Earth, researchers said.

Grotzinger, a geologist at Caltech in Pasadena, said he meant to convey the excitement his team felt to see SAM ? a mobile chemistry lab that takes up more than half of Curiosity's science payload by weight ? working according to plan on Mars. He was surprised by the way his words rocketed around the Internet.

"We're doing science at the speed of science. We live in a world that's sort of at the pace of Instagrams," Grotzinger said during Monday's press conference. "The enthusiasm that we had ? that I had, that our whole team has about what's going on here ? I think was just misunderstood."

"What I've learned in this is that you have to be careful about what you say, and even more careful about how you say it," he added.

After some reflection, Grotzinger came to see some positives in the way the world latched onto his words.

"As the days went by and I thought about it further, my reaction was, I think it's terrific that this mission has such wide appeal and public interest," he said. "That's everything that I think we're hoping for, and the mission has delivered an unbelievable wealth of data."

Chlorinated compounds

SAM heats up soil samples and identifies the chemical species that boil out of the dirt. It's possible that the newly observed chlorinated compounds result from the decomposition of perchlorate, a chemical that NASA's Phoenix lander detected near the Martian north pole in 2008, researchers said.

"I think it's very likely that the chlorinated compounds that we saw ? chloromethane, dichloromethane and trichloromethane ? were actually produced as this perchlorate broke up and some very reactive chlorine was released, and then that reacted with carbon," said SAM principal investigator Paul Mahaffy of NASA's Goddard Space Flight Center in Greenbelt, Md.

"The thing we have to untangle is, what form of carbon was that reacting with?" Mahaffy added. "Was it some of the CO2 that was being released also, at the same time? Or was it from some other source of carbon?"

The Curiosity team is working on such questions right now, as the rover nears its four-month anniversary on the Martian surface. The $2.5 billion rover landed Aug. 5 inside Mars' huge Gale Crater, kicking off a two-year prime mission to determine if the Red Planet could ever have supported microbial life.

Declining air pollution levels continue to improve life expectancy in US

A new study led by researchers at Harvard School of Public Health (HSPH) has found an association between reductions in fine particulate matter and improved life expectancy in 545 counties in the U.S. from 2000 to 2007. It is the largest study to date to find beneficial effects to public health of continuing to reduce air pollution levels in the U.S.

The study appears in the December 3, 2012 online edition of the journal Epidemiology.

"Despite the fact that the U.S. population as a whole is exposed to much lower levels of air pollution than 30 years ago?because of great strides made to reduce people's exposure?it appears that further reductions in air pollution levels would continue to benefit public health," said lead author Andrew Correia, a PhD candidate in the Department of Biostatistics at HSPH.

The study looked at the effects on health of fine particulate matter, small particles of 2.5 micrometers or less in diameter?referred to as PM2.5. Numerous studies have shown associations between acute and chronic exposure to fine particle air pollution and cardiopulmonary disease and mortality. Studies have also shown that reductions in air pollution are associated with reductions in adverse health effects and improved life expectancy. Air pollution has been declining steadily in the U.S. since 1980, but the rate has slowed in the years since 2000. The HSPH researchers wanted to know whether the relatively smaller decreases in PM2.5 levels since 2000 are still improving life expectancy.

Controlling for socioeconomic status, smoking prevalence, and demographic characteristics, the results showed that a decrease of 10 micrograms per cubic meter (10 ?g/m3 ) in the concentration of PM2.5 during the period 2000 to 2007 was associated with an average increase in life expectancy of 0.35 years in 545 U.S. counties.

The research expanded on a 2009 study published in the New England Journal of Medicine by some of the same authors (Pope, Ezzati, and Dockery) that found that reduced air pollution was associated with increased life expectancy in 211 urban counties. This new study looked at more recent data, more than two-and-a-half times as many counties, and included both rural and urban areas. The findings showed that there's a stronger association between declining air pollution and increased life expectancy in more urban, densely populated areas than in rural areas. The results also suggested that reduced levels of air pollution may be more beneficial to women than to men.

As to why there was a stronger association between reductions in fine particulate matter and improvements in life expectancy in urban areas, the researchers speculated that the composition of the particulates there may be different from that in rural areas.

"Since the 1970s, enactment of increasingly stringent air quality controls has led to improvements in ambient air quality in the United States at costs that the U.S. Environ?mental Protection Agency has estimated as high as $25 billion per year. However, the extent to which more recent regulatory actions have benefited public health remains in question. This study provides strong and compelling evidence that continuing to reduce ambient levels of PM2.5 prolongs life," said senior author Francesca Dominici, professor of biostatistics at HSPH.

Judge fears gay conversion therapy ban's unintended consequences

SACRAMENTO (Reuters) - A federal judge on Monday expressed concerns over the unintended consequences of a landmark California law that bars a controversial therapy aimed at reversing homosexuality in minors as a Christian group argued the law should be halted.

California's Democratic governor, Jerry Brown, in September signed into law a ban against so-called conversion therapy for children and teenagers, making the nation's most populous state the first in the country to do so.

Gay rights advocates say the therapy can psychologically harm gay and lesbian youths, leading to depression or, in the worst cases, suicide.

A judge hearing arguments by the second of two Christian legal groups that filed suit in the U.S. District Court for the Eastern District of California seeking to prevent the ban from taking effect expressed concerns that banning licensed practitioners from offering the therapy would only drive parents to seek out the treatment from unlicensed providers.

"That's what they used to do with abortions. It didn't work very well," Judge William Shubb said, mentioning back-alley procedures that endangered women's health. "It may also be the opposite of what the state was trying to accomplish."

The law, due to go into effect on January 1, bars therapists from performing sexual-orientation change counseling with children and teenagers under 18 and was supported by the California Psychological Association.

Passage of the law marked a major victory for gay rights advocates who say the treatment, also called reparative therapy, has no medical basis because homosexuality is not a disorder.

Lawyers for the plaintiffs in the case, filed by the Christian legal group Pacific Justice Institute, argued that the law violates constitutionally protected rights to free speech and freedom of religion.

Attorneys for the state were joined by lawyers from Equality California, which was a sponsor of the bill, in arguing that there is substantial evidence that the practice causes harm to those who undergo it.

An attorney for Equality California, Michelle Friedland, argued that California's licensing boards should not condone a practice admonished by major medical organizations, and it would be unethical for therapists to refer their clients to a treatment that was scientifically discredited.

The bill's sponsor, state Senator Ted Lieu, a Democrat from the Los Angeles suburb of Torrance, told Reuters after he attended the hearing that he hopes California's prohibition of the practice would spur those who might be tempted to get the treatment elsewhere to pause and carefully consider why the state had banned the practice.

Shubb indicated he would rule soon in the case, filed against Brown and other state officials. Another similar suit seeking a separate injunction against the law was argued on Friday, and the judge in that case indicated she would rule this week.
